Will or No Will…

When an individual dies, the survivors are faced with the grief and pain of the loss of a loved one. Worrying about the deceased’s estate only compounds the heartache and loss for the survivors. Blutter & Blutter understands and appreciates the fragile and difficult nature of this situation for the surviving family members. With great sensitivity, the firm will handle the probate of the estate including the preparation and filing of the petition, obtaining letters testamentary or letters of administration, preparation and filing of any estate tax returns and estate accounting.

Occasionally, in the area of wills and trusts, a question of undue influence will arise.  This occurs when it is suspected that the testator (the person making the will) was so controlled by pressure or persuasion of another, that he/she (the testator) substituted the wishes of that other person rather than his/her own wishes in drawing up the will or trust.    For example, such action can occur if the testator is elderly, physically ill, mentally weak or ignorant.  This undue influence in wills and trusts must amount to coercion which destroys the free will of the testator.

Advanced Directives of Care

Since the contentious case of the comatose woman in Florida, there has been great interest in the preparation of advanced directives of living wills, health care proxies, and durable powers of attorneys. Living wills are statements that inform the medical community that no extraordinary care is to be given to an individual when that person has reached a state of being permanently unconscious or is in a persistent vegetative state with no chance of recovery. The only care to be given is that which will alleviate pain and allow an individual to die with dignity, a good death. Blutter & Blutter will consult, prepare, and assist in the execution of this important and timely document.

Health care proxies are like medical powers of attorney. In this document, an individual appoints a person to handle all medical decisions if the patient is unable to speak or communicate for himself/herself. Basically the agent steps into the shoes of the patient if the patient is unable to communicate. Blutter & Blutter will consult, prepare, and assist in the execution of this document which is often done at the same time as the living will.

When preparing, consulting, and assisting in the execution of the living will and health care proxy, Blutter & Blutter understands and appreciates the sensitive nature of a person’s feelings when contemplating the end of life.

A durable power of attorney permits an individual, the attorney-in-fact, to handle a variety of matters for another individual who is unable or unwilling to handle such matters himself/herself. The power of attorney is durable since it will survive the grantor’s incompetency. This document does not cover medical matters. Trusts

An irrevocable trust is one of the two types of well-known trusts. A revocable trust can be cancelled by the creator of the trust. An irrevocable trust cannot be revoked. A trustee has control of the assets placed in the trust on behalf of a beneficiary who has the right of enjoyment of the property. A testamentary trust is a trust that goes into effect when the testament or will takes effect.
